In 2012 International art rock star Jeff Koons was awarded the first United States Medal of Art by Secretary of State Hillary Clinton. In the introductory speech Hillary tells the world that public-private relationships are at the core of what everything the United States does. Jeff Koons is the highest paid living artist in the world. Koons is also a minimalist artist who has reduced the content of his art to pure marketing. Should Hillary and Koons be surprised that when Koons delivered a speech to 1000 Chinese listeners that the response from the eternal international dialogue was to copy Koons work and produce and sell it for less? How does Koons's marketing art interact with the Maine art world?

Preserving The American Political Philosophy: Why Two Terms Of Agreement on The New England Foundation For The Arts Website ?
In 2007 I found the New England Foundation For The Arts website and data base and went to sign up but when I looked at the Terms of Agreement I was shocked as it literally claimed rights over what was published through its services for all of eternity, everywhere with no exit .In addition it claims the right to change the work while insisting that the user forgo all rights to sue and any moral rights and more. Since then I have been off and on again corresponding with NEFA, only to be dismissed. Recently I learned that there are now two Terms of Agreement on the NEFA website.- one which displays when one registers and another- the one I have been protesting for seven years- in the footer- both claiming to be the ultimate authority-and both appearing at first to be identical, except for one subtle difference in the two paragraphs. This post includes some observations about the difference and thoughts on what it means and why.- from a layman's view.

Preserving The American Political Philosophy: Christmas Banned at The University of Maine ( A Corporate Instrumentality of the State! )
WBAI reports that the Christmas decorations at the University of Maine were up a few days ago and have now all come down. An anonymous university "spokesperson" has issued a statement. The media cannot identify who issued the directive. In 1981 the Maine State legislature deemed the University of Maine to be a corporate instrumentality of the state. In 1995 the Maine legislature authorized itself to have jurisdiction over education at the University of Maine. Since about 2002 a minor in Marxist and Socialist Studied has been instituted at The University of Maine. In 2013 the Maine legislature sold a piece of the University of Maine to the Confucius Institute and passed a statute affirming Maine's friendship with Communist China declaring "shared values". Is the Maine State legislature also behind the banning of Christmas at the University of Maine?

Added more to this post about the Architects of Maine s transformation from state functioning as a free enterprise system to a state centrally managed by a power elite and a deeply entrenched system of state corporation which is fundamentally repugnant to the Maine State Constitution. This post goes back to 1976 when Governor Longley brought in the heads of Maine industry to reinvent Maine's governing system. While the Governor and the Legislature had taken oaths of loyalty to the Maine Constitution, the heads of Industry had not. This powerful faction advised the heads of government to pass legislation allowing the tax system to be appropriated to the benefit of the profit motives of private investors.

Jonathan Gruber, an architect of Obamacare bragged about how the United States legislature passed ObamaCare , turning over a sixth of the U.S. economy to the government, Gruber admitted that the Obama administration went through "tortuous" measures to keep the facts about the legislation from the American people, including covering up the redistribution of wealth. The Architects of Obama Care don't have anything over the Maine Legislature which has likewise taken over massive portions of the Maine economy and in the process embedded a vast unconstitutional network of state corporations which redistributes the wealth of the people using equally manipulative ethics codified into statutory law. 5 out of 6 bonds recently voted in by the people of Maine will be distributed through the unconstitutional corporate state network. This morning I asked the question of Mainers, if the bond question on their ballots conform with constitutional requirements, After going to vote, the answer is that none of the constitutional requirements are listed on the ballot, meaning that constitutionally even if the bonds win public approval, their enactment cannot be constitutionally ratified- But in a state where the political culture routinely dismisses the constitution and sometimes even their own statutes- will it matter?

UPDATE! In Boothbay, Maine, the bond questions on the ballot are not compliant with what is essential for the validity of the bonds to be issued pursuant to the Maine Constitution. None of the requirements set forth in Article IX Section 14 were on the ballot. Only the total amount of the bond debt and the interest is listed with each bond question. This means that constitutionally , what ever the outcome of the vote, the enactment of the bonds cannot be ratified.

Preserving The American Political Philosophy: Why Maine Should Say NO to Bonds!
I finished my analysis of the bonds on the Maine ballot that I started yesterday. All but one of the bonds are to be dispersed through the corporate network of Maine State Inc -in other words they are a hidden means of under writing the ongoing operation of an unconstitutional state corporation- My analysis explains why, in my opinion, that is a very bad idea. The ONE bond which will not be dispersed by the corporate state is the bond in support of clean water. This will be dispersed as a real state function and benefits all of the people equally. In my research of the 2013 legislative session, I saw that it is difficult for a bill supporting environmental concerns to compete against the business interests of the corporate state and so I think it would be real "social justice" to support the clean water bond and nix all the rest. Since around 1977, the Maine State legislature has established a deeply entrenched network of unconstitutional state corporations, which has transformed, in practice, Maine State to Maine State Inc, operating for the benefit of corporate profits and using all as instrumentalities of the state (corporation). Every election the legislature presents a full package of bonds for public approval which are used to finance the on-going operations of Maine State Inc. These bonds are presented with the usual glossy surface rhetoric of creating jobs but to understand their full purpose, one needs to look deeper at the statutes that have entrenched Maine State Inc over the Maine State Constitution as the governing authority of Maine. Candidate Anna Morkeski, of Newcastle, running for Maine State Representative is on the right track in making local governance over state dominance a campaign issue- but in terms of right to work, it needs to be factored in that the Pine Tree Zone tax credits make the state the hidden Union negotiator and the general taxpayer the payer of union dues whether the taxpayer benefits or not. In today's political dialogue in Maine, there is no discussion about the political philosophy of state corporatism which has been entrenched in this state through repeated constitutional violations by R's D's and I's alike. There is no political party representing the true constitution of Maine and the free enterprise system. In 2013 The Maine legislature passed a bill called Industry Partnerships, which created a new government function granting the state wide spread authority to manage relationships between businesses and people in the private sector. Now Governor Lepage is talking about taking care of student debt by selling it to companies who will hire the students and also get a tax credit- which in Maine likely means a cash payout from taxpayers. Andersen Studio Evolution Diaries: Darma Art and Other Rambing Thoughts on How and Why to Craft a Successful Crowdfunder
Andersen Studio-Design is a small independent private sector American Ceramic design and slip-casting enterprise, in existence since 1952. We need to raise capital in order to preserve our business in a way that can be carried on by future generations of ceramic designers and crafters . However, being so independent has its drawbacks- we don't have an easily accessed network of support needed to pull off a successful crowd funder. I see the most likely avenue of support as coming from the Conscious Capitalism movement started by John Mackey who founded Whole Foods, but how does one get the attention of a Mr Mackey and/or other other influencer willing to lend their name in support of our project? I suppose one can start by spreading the word- which is what I am doing now in this rambling and philosophical post about where Andersen Studio finds itself in today's world and how a company like Andersen Studio can make this world a better place in ways not usually considered in contempora

I recreated it but the link is now different and so I am posting it again with new link Mikkel Clair Nissen is a Danish psychologist who has written a book exposing the the life and general psychology of Danish people under socialism. He is so much on the same page as I am on in my blog and he is a passionate spokesperson and an eloquent writer. How is State Capitalism working out in Maine?
Under state capitalism cloaked in the language of quasi's and public-private relationships. the Maine State legislature accommodates the interests of state capitalism and/or it's chosen private beneficiaries by routinely rewriting the laws. When the state liquor contract laws were re-written to accommodate one company while making the incentives system of another bidder illegal, why was Governor Lepage so disappointed that there was only one bidder- the one for which the law was tailor made?

Preserving The American Political Philosophy: In 1981 Maine Legislature Grants Itself The Authority to Centrally Manage Economy
In 1981 The Maine Legislature deemed itself the authority to centrally manage the Maine economy bypassing getting the consent of the governed. In the process they established a state municipal bond bank and granted it unlimited power. In the years since the legislature continued to construct a massive network of state corporations. Today managing the state corporations is seen as the primary function of the legislature's and administration by those in that position. Although all must take an oath to uphold the constitution, when asked about the Constitutional prohibition against the legislature chartering corporations, the usual answer is "Oh where does it say that ?" Only in the section on Legislative Powers!

Twitter Exchange with Steve Woods Continues Via Proxy Abigail Adams
Yesterday's twitter exchange with Steve Woods over discrepancy over what was said at an elaborate award ceremony and what was revealed in a freedom of information request continues via proxy, Abigail Adams, who has a mission to clear Mr Wood's name and establish that Tide Smart Global did indeed receive stimulus funds- to help the project find private financing. Steve Woods is running for the Maine legislature and advocates relocating rural populations to urban centers because they are not providing their fair share of revenue to Maine State Inc. The rural communities received minimalistic stimulus funding.

My twitter exchange with Democratic Candidate for Maine Senate, Mr Steve Woods over PR Newswire article in which MR Woods and Governor John Baldacci thank President Obama for the stimulus funds to build Tide Smart Global Business Plaza. A freedom of information request to David Heidrich, Jr. Assistant Director of Communications Department of Administrative and Financial Services Maine Government revealed no vendor by the name of Tide Smart Global - or any variation there of in the state records,- also none found on Recovery.org. Mr Woods first mocks my question and then acknowledges that it is based in truth.

Preserving The American Political Philosophy: Maine Gov Rules- Request a Certified Copy- But Don't Use Them In Court!
When I first published "How Maine's Home Rule Amendment Was Superseded By Statutory Law". the Rules for Non-profit Corporations were found on line- Now that link no longer displays those rules and one must download the document which displays the rules. The doc is available for download on the Maine Secretary of State's webpage with a long list of other rules which come with this warning: WARNING: While we have taken care with the accuracy of the files accessible here, they are not "official" state rules in the sense that they can be used before a court.
